A founding partner of Timken Johnson LLP, Heidi A. Timken works with clients in northern California. She centers her practice on real estate law, focusing on the Racketeer Influenced and Corrupt Organizations (RICO) Act, title insurance, eminent domain, inverse condemnation and real estate litigation. Her cases have included lender/broker fraud, environmental clean-up and escrow negligence.

After graduating from Brown University with a Bachelor of Arts in political science in 1985, Ms. Timken went to Golden Gate University School of Law. She received her Juris Doctor with honors in 1991. While attending law school, Ms. Timken was recognized for her academic achievements and her skills in trial advocacy, receiving multiple commendations.

With over 20 years of experience working in real estate law, Ms. Timkens has won many multimillion-dollar awards for her clients. She has represented home owners, land developers and investors. Her largest award was for an inverse condemnation case against San Bernardino County, winning a $102 million settlement for her clients. Ms. Timkens is a member of the Contra Costa County Bar Association and her dedication to legal ethics and skills has earned her the highest rating of AV-Preeminent* from Martindale-Hubbell.

Ms. Timkens is active in the legal community and local organizations. She is involved in her law firm’s efforts to collect donations for a food bank, a prenatal program for homeless women and a rescue. She is a member of the local chapter for Commercial Real Estate Women and has served as a president, president-elect and committee chairperson for the organization. Ms. Timkens has also served on an executive committee for diversity through the Contra Costa County Bar Association. She also shares her legal knowledge with others as a speaker at several functions.

Verdicts and Settlements:

  • Caltrans sued our clients in eminent domain to acquire their brand new dream home. Jury awarded $1.2 million in just compensation; trial court awarded $400,000 in precondemnation damages for Caltrans unreasonable delay and unreasonable conduct and awarded all litigation expenses; Caltrans appealed the court's rulings and the matter is currently pending.
  • Represented land owners in contemporaneous quiet title and inverse condemnation actions against the Flood Control District and the County; the trial court found that the District had no easements to compel the use of 72 acres of the clients' property for regional flood control facilities. The Court further found that the District had coerced and deceived the clients in its dealings with them. Following sustained efforts to resolve the clients' pending lawsuit for inverse condemnation, the County approved a $102 million settlement of the clients' claims.
  • Represented a private property owner in a condemnation action. After a 7 day trial, jury awarded more than $6 million
  • Represented the Flood Control District against several major oil companies to seek recovery of clean up costs expended by the District along the banks of the Napa River to remediate decades of contamination. The District obtained approximately $5 million in a mediated settlement.
  • $1.6 million jury verdict/court decision in eminent domain and precondemnation damages and $608,000 award of litigation expenses, 2010
  • $650,000 settlement with San Bernardino County (inverse condemnation), 2009
  • $1.2 million settlement with Contra Costa County Bypass Authority, 2007
  • $11.8 million settlement with BART (eminent domain), 2005
  • $6.7 million verdict against City of Dublin (eminent domain), 2004
  • $18 million settlement with Caltrans (eminent domain), 2003 
  • $700,000 settlement with East Bay Municipal Utilities Dist (eminent domain), 2002
  • $27.5 million verdict against BART (eminent domain) - 2001
  • Defense verdict on $60 million RICO claim, 2001
