We win high-stakes federal trials. Mr. Katz has won all eight of his last eight: an acquittal in a telemarketing case, an acquittal in a pharmaceuticals trial, a $1.8 million police brutality verdict, hung juries in customs fraud and tax fraud cases, an eve-of-trial dismissal, and acquittal in a state fraud case. This August the Ninth Circuit reversed the sole conviction in the eight cases. In the last 20 years, we obtained numerous dismissals and misdemeanor dispositions in felony cases. Current clients include the founder of an international manufacturing company and major companies. Bilingual, Mr. Katz graduated from UC Berkeley and Boalt Hall, edited the California Law Review, clerked for U.S. District Judge John Penn, was an Assistant U.S. Attorney, and headed the Investment Fraud Task Force.

Other Outstanding Achievements:

  • Representing the number-two defendant in a 70-defendant RICO case described by the government as the largest white-collar prosecutions in Southern California in 2011. The U.S. Attorney himself held a press conference along with the Chief of the Criminal Division of the U.S. Department of Justice in Washington DC to announce the indictment. The case was indicted in February 2011 and is scheduled for trial in May 2012.
  • Represented two sisters who ran a multi-million dollar company that imported teddy bears from China and shipped them to South America. The government indicted the sisters for currency violations. David Katz represented the two sisters at their bail hearings in July 2010. The government moved to hold them without bail. Over the government’s strenuous objection, he was able to obtain their immediate release on bail. Subsequently, Katz defeated the government’s efforts to judge-shop the case, and won other pre-trial matters. The case was recently resolved on terms acceptable to the sisters. The case was extensively reported last summer, including in newspapers than run Associated Press stories, the Wall Street Journal and the Los Angeles Times.
  • In Katz' last eight trials he obtained three not-guilty verdicts, an eve-of-trial dismissal, a reversal of the only conviction, two hung juries in the remaining two criminal trials (5-7 and 9-3 to acquit), and in the only civil trial a plaintiff’s verdict for $1.8 million.
  • Won a reversal in a published decision in the Ninth Circuit appeal in United States v. Kloehn, 620 F.3d 1123 (9th Cir. August 30, 2010). The case, which alleged multiple counts of tax evasion by my client and his international manufacturing company, received extensive media coverage.
