Jim Hartley has been a trial lawyer since 1974 practicing in the areas of patent infringement litigation and antitrust litigation and counseling. He takes particular pride in his ability to simplify complex technical and factual disputes for presentation to a judge or jury.
Mr. Hartley has been responsible for over thirty significant patent infringement lawsuits, including a number of successful jury trials, and several TRO or preliminary injunction evidentiary hearings before the court. He has handled many Markman hearings, which have resulted in highly favorable claim interpretation rulings. These cases have involved diverse products such as computer software, signal processing, fiber optics, data and voice compression, computer hardware, agricultural chemicals, oil recovery systems, medical instruments, portable canopies, and other consumer products.
Mr. Hartley also has extensive trial experience in cases dealing with claims involving trade secrets, trademark and copyright infringement and unfair competition. For over 30 years, he has served as regional copyright counsel for the American Society of Composers, Authors and Publishers.
Mr. Hartley's antitrust experience spans his entire career, during which he has represented a wide range of clients in circumstances involving both antitrust litigation and counseling. He has been lead counsel or actively involved in four successful jury trials involving antitrust claims, and represented clients in a wide variety of cases involving horizontal and vertical restraints, monopolization claims, and mergers challenged under Section 7 of the Clayton Act. Mr. Hartley has represented clients before state and federal criminal grand juries and defended deceptive practice cases brought by the Federal Trade Commission. In addition, he has advised clients concerning premerger notification rules and frequently makes presentations about antitrust compliance procedures. He also has extensive experience with patent misuse and related defenses in patent infringement actions.
Mr. Hartley has particular experience in dealing with the antitrust issues arising in the healthcare industry, and also has represented clients in businesses as diverse as manufacturing, cattle feeding and beef packing, construction, building materials, cable television, banking, transportation, agriculture, energy and natural resources, lumber, insurance, electronics, professional sports, and labor relations.
