Profile

Paul H. Amundsen has over 30 years experience in the practice of administrative law, appellate law and litigation in Florida.  He is rated "AV" by the Martindale-Hubbell legal directory.  Paul has tried numerous cases before the Florida Division of Administrative Hearings and state and federal courts.  Proficient in Florida administrative procedure, he has participated in appellate cases that have influenced the direction of Florida administrative law.  Paul communicates regularly with governmental agencies on behalf of clients. A frequent speaker and author on regulatory issues, Paul has spoken at seminars at various Florida Bar programs, and has served as a panelist at the annual Patricia A. Dore Administrative Law Conference in Tallahassee.  He has served as a guest lecturer at the FSU College of Law and the FSU College of Business.  On several occasions, he was selected as a faculty member for the Florida Chamber's Environmental Permitting School.  Paul is a member of the American Bar Association, the American Health Lawyers Association and the Florida Bar's Sections on Health Care Law, Appellate Practice and Environmental and Land Use Law.  He is the former President of the Florida Section of the Air & Waste Management Association (A&WMA) and the founding President of the A&WMA's Big Bend Chapter.   In 2005, Paul was appointed to Florida Bar's Grievance Committee for the Second Judicial Circuit.  He is a member of the Board of Visitors of Elon University where he received his undergraduate degree. During law school, Paul served on the Editorial Board of the Florida State University Law Review.  He received his J.D. degree with honors.  Paul was admitted to the Florida Bar in 1978 and to practice before the following federal courts: United States Circuit Courts for the District of Columbia, Fifth and Eleventh Circuits,  all United States District Courts in Florida and the United States Court of Claims. In November 2007, Paul became one of only 56 Florida lawyers whom The Florida Bar certified in November 2007 as specialists in the newly-established state and federal government and administrative practice specialty, the first area of its kind in the U.S.  Certified attorneys are the only Florida lawyers allowed to identify or advertise themselves as specialists or experts.  Certification is the highest level of evaluation by The Florida Bar of the competency and experience of attorneys in areas of law approved for certification by the Supreme Court of Florida.  Board certification evaluates attorneys' special knowledge, skills and proficiency in various areas of law and professionalism and ethics in practice.

Verdicts and Settlements: Recent reported decisions wherein the firm served as appellate counsel:  Residential Plaza at Blue Lagoon, Inc. v. Agency for Health Care Administration, 891 So. 2d 604 (Fla. 1st DCA 2005).  The court reversed the Agency for Health Care Administration's denial of an assisted living facility's extended congregate care license and awarded appellate attorney's fees, finding that the agency's action that precipitated the appeal was a "gross abuse of discretion." Bay Point Club, Inc. v. Bay County, 890 So. 2d 256 (Fla. 1st DCA 2004),  petition for review denied, Case No. SC05-0260 (May 11, 2005).  The court affirmed, en banc, the Florida Land and Water Adjudicatory Commission's finding that a developer's non-regional changes to a development of regional impact are inconsistent with the local government's comprehensive land use plan, thereby receding from the court's recent prior decision in Edgewater Beach Owners Association, Inc. v. Walton County, 833 So. 2d 215 (Fla. 1st DCA 2002). Bethesda Healthcare System v. Agency for Healthcare Administration, 829 So. 2d 353 (Fla. 1st DCA 2002).  Successfully defended Administrative Law Judge's Final Order upholding the validity of an agency rule.  Represented health care facility in trial below.  Seal v. Brown, 801 So. 2d 993 (Fla. 1st DCA 2001).  Successfully obtained reversal of trial court's summary judgment.  Represented plaintiff below in action to rescind sale of real estate. Friends of Nassau County, Inc. v. Nassau County, 752 So. 2d 42 (Fla. 1st DCA 2000).  Successfully obtained reversal of Administrative Law Judge's award of attorneys' fees against petitioner and petitioner's counsel.  Did not represent parties in proceedings below.
