Professional Experience:Rachael Loukonen is a partner with the firm and has practiced law since 2003. Rachael focuses her practice on trial work, litigation, and dispute resolution, representing businesses and individuals in matters involving complex property, commercial business, construction, and employment issues. Rachael’s work includes pretrial motions, preliminary hearings, depositions, arbitrations, mediations, witness and expert preparation, trials, and appellate proceedings. Rachael regularly counsels and meets with clients to assess their legal needs, strategize with clients, and determine how the firm may assist. Rachael was recognized by Gulfshore Business Magazine as one of Southwest Florida’s top 40 leaders under 40 years old. Representative Matters:- Successfully represented a business seeking a temporary injunction to restore the public's access to its business. -Successfully represented clients involved in property purchase agreements. -Single-handedly represented a client in arbitrating and favorably resolving a complex property dispute. - Sat as first chair in a trial involving a contentious landlord/tenant action.- Represented a construction company in a two-week bench trial involving a complex construction dispute between a general contractor and a subcontractor related to work performed on a high-rise condominium building. - Sat as second chair in a one-week trial involving a multi-million dollar property dispute, which resulted in a favorable decision for the client. - Sitting as first chair, represented a construction company in a two-day jury trial regarding unpaid overtime. The jury returned a winning verdict for the client. - Represented a hotel owner in a one-week jury trial involving architectural liability for work provided by the architect to the client’s hotel property. The jury returned a favorable verdict. - Argued before the Second District Court of Appeals concerning whether her clients, the high bidders at a foreclosure sale, would retain title to a million dollar home. Briefed the Second District Court of Appeals and argued against counsel for the mortgage companies. The Second District Court of Appeals affirmed the trial court’s decision and the clients retained their ownership interest in the property. - Regularly works with construction companies concerning construction defects and resolving construction disputes on high rises and multi-story condominium developments. Attorney Publications:Rachael co-authored Chapter 3, Slander of Title, in the Florida Real Property Litigation, 5th Edition, The Florida Bar (2009) and has been asked to co-author this Chapter for the 6th Edition, which will be printed next year.
