For more than 24 years, we have assisted both not-for profit as well as for-profit health organizations, physicians, health care facilities, other licensed professionals and health care businesses in navigating and surviving the heavily regulated health care industry by negotiating and/or preparing specialized contracts, structuring sales, mergers and acquisitions, giving proactive Stark Law and fraud and abuse advice, Corporate Compliance Plans, Medicare and Medicaid reimbursement counsel and more.  We pride ourselves on being accessible, current, practical as well as creative in finding solutions that work in the real world, within the complex and changing regulatory environment.  Our clients are those who seek to operate lawfully and provide high quality care to their patients, often in dificult competitive markets where not all players do the same.  We are significantly involved in the design and creation of a Health Information Exchange for the State of Florida and the South Florida health care community, which when fully implemented, will help reduce duplication and therefore the cost of health care services, as well as improve the quality of care for patients by helping to eliminate errors and measure outcomes.  Ms. Greenblatt is an author of multiple publications on health law topics, including negotiating technology contracts, group practices and fraud and abuse/Stark Law, and is a sought after speaker at national and regional legal and health care organizations.  She has been honored by both the legal and health care communities and is very appreciative for all the support of her clients, peers and the community.

Negotiating Technology Contracts in Health Care (2009)

This is a Chapter I wrote in the 2007 and updated in the 2009 Florida Practitioners' Health Law Handbooks, published by The Florida Bar Health Law Section, available through The Florida Bar.  It discusses the need to negotiate vendor contracts for hardware purchases, software licensing, as well as the maintenance and support agreements that accompany them.  Standard vendor contracts are one sided in favor of the vendors.  Promises made during sales presentations are worthless unless incorporated into written contracts or purchasers often find themselves with no warranties or remedies when technology does not perform as promised.
