Scott Gyllenborg is a sixth generation Johnson County, Kansan who has practiced criminal law since he graduated from the University of Kansas School of Law in 1988. He is the managing partner of Gyllenborg & Dunn, P.A., a top-rated criminal defense law firm located in Olathe, Kansas. Members of the firm defend individuals and businesses being investigated for or accused of crimes in the federal, state, and municipal courts of Kansas. The firm's clients range from persons charged with premeditated murder to those charged with driving under the influence of drugs or alcohol, and nearly every other crime under Kansas law. Gyllenborg & Dunn's lawyers spend every business day involved in criminal cases, and make their living in the criminal courts. Scott is a former assistant district attorney in Johnson County, and is the former president of the 1,700-member Johnson County Bar Association. He is the co-chairman of the Association's Criminal Law Bench/Bar Committee, the chairman of the Membership Committee, and the editor of the BarLetter, the Association's membership publication. Scott is an Adjunct Professor of Law at the University of Kansas School of Law, teaching Trial Advocacy to second and third year law students.

Scholarly Lectures and Writings:

  • Padilla v. Kentucky extends the Sixth Amendment’s protection of effective assistance of counsel to nonresident criminal defendants by conferring on them a constitutional right to be advised by counsel of the deportation consequences of a plea. At the same time, it burdens criminal defense counsel with the duty to give correct advice when the deportation consequence is clear, and with the limited duty to advise the client of the risk of adverse immigration consequences when the consequences are unclear or uncertain. Only time will tell if Padilla has opened the door to a further expansion of Strickland to protect criminal defendants who are subject to other consequences of a plea that are as closely related to a conviction as deportation is, such as civil commitment, civil forfeiture, the loss of the ability to vote, or the requirement to register as a sex offender or violent offender., Author, Effective Assistance Of Counsel To An Alien Criminal Defendant Under The Sixth Amendment After Padilla v.
