Profile

Mitchell T "Mitch" Foster, founder of Mitch Foster Law, represents individuals accused of felonies, misdemeanors, traffic tickets, drunk driving, operating while intoxicated by alcohol or drugs, operating while impaired, and DUI throughout Michigan. He has gained recent acquittals "not guilty verdicts" for clients accused of assault and battery, domestic violence, criminal sexual conduct, home invasion first degree, larceny, breaking and entering, fleeing and eluding police, driving while license suspended, possession with intent to deliver controlled substance, drug delivery, and malicious destruction of building. Mr. Foster also handles criminal appeals, having gained early releases for several clients serving prison and county jail sentences. Mitch had a felony maintaining a drug house conviction overturned by the Michigan Supreme Court after a successful appeal from the Michigan Court of Appeals.  Mitch recently appealed the sentence of a client serving prison time for drunk driving and had this minimum sentence reduced by 9 months.  In 2009, Mitch appealed a conviction of a weapons possession charge, and this conviction was overturned by a circuit judge after Mitch filed a motion in that court.  Mitch graduated from University of Detroit Mercy School of Law in 1992.   • Felonious Assault charges against Mitch's client dismissed by Oakland County Prosecutor's Office, 2008
  • Weapons conviction for one of Mitch's clients overturned by Chippewa County Circuit Judge, 2009
  • not guilty verdict in 48th District Court to the charge of malicious destruction of building, 2009
  • Successfully appealed implied consent breath test refusal in front of secretary of state hearing officer, 2010

Other Outstanding Achievements:

  • Participation in the Michigan Supreme Court's "Court Community Connections" Program in Historic Barry County Courthouse.  Successfully argued against the Macomb County Prosecutor's coercive "all or nothing" packgage plea bargain policy.  On June 13, 2008, the Supreme Court ruled that there was an inadequate factual basis for the client's guilty plea and reversed his plea based conviction.  The program included a luncheon, and after argument debriefing with questions and answers with local high school students, to help educate them on the legal system and the experience before the Supreme Court.  People v.
