Profile

Kramer Kozek LLP is a boutique family and matrimonial law firm. The practice includes litigation as well as collaborative practice and traditional negotiated settlements.

REDEFINING DIVORCE Neil E. Kozek is a leader in the collaborative divorce movement. When couples choose collaborative family law (also known as “collaborative practice” or “collaborative divorce”), an affable divorce becomes reality. Collaborative law began in the 1990s as an alternative to litigation and mediation in family law cases, and Kramer Kozek LLP has pioneered the practice in New York with a group of similar visionaries since 1999. Collaborative law is a structured, cost-effective and client-centered approach in which the participants agree on mutual goals. It involves a commitment to discuss issues openly and with dignity; the attorneys commit to resolve the matter without going to court.

Partner and firm co-founder Neil E. Kozek explains that collaborative law is redefining divorce. “Clients are able to resolve cases so that both parties feel that their needs have been met,” Kozek says. Unlike traditional litigation-based divorce proceedings that often create hostility and acrimony for families, collaborative law involves an interest-based negotiating technique that reduces animosity. Instead of destroying families, the collaborative process is an opportunity to restructure and redefine a family. Parents stay supportive of each other and children emerge feeling loved, respected and cared for.

A CLIENT-BASED APPROACH Not every case can benefit from the collaborative process, and Kramer Kozek effectively litigates for clients as well. “We still do go to court. In fact, we’re very good at it,” Kozek says. The firm’s philosophy of respect and collegiality is evident in the courtroom. “Your reputation is everything,” Kozek says. Kramer Kozek’s lawyers are reasonable and professional at all levels, which has earned them the respect of judges and colleagues alike.
