Mr. Barnes is a commercial litigator, focusing on breach of contract, commercial tort, unfair competition and business fraud claims, and has been engaged to represent individuals and businesses of all sizes in complex matters, including RICO claims, sophisticated commercial fraud, claims premised upon federal and state statutes, mortgage fraud, the Martin Act and multi-district litigation. He frequently litigates restrictive covenant claims, non-competition and unfair competition matters, trade secret and breach of duty of loyalty actions for both the plaintiff and defense, and likewise pursues and defends claims seeking provisional relief related to the same, including preliminary injunctions, temporary restraining orders, attachment, replevin and receivership. When criminal misconduct is alleged, Mr. Barnes works side-by-side with a client’s criminal defense counsel to minimize the corresponding civil ramifications.
In addition to the commercial practice, Mr. Barnes maintains an active real estate litigation docket, including claims by owners, lessees, insurance companies and developers for breach of contracts of sale, specific performance, partition proceedings, adverse possession, boundary disputes, brokerage commission disputes, title company claims and actions pursuant to the Lien Law. The real property litigation practice also encompasses counsel to general contractors, sub-contractors, owners, architects and engineers in all aspects of private construction disputes.

- Mr. Barnes is licensed to practice in New York and New Jersey, and is admitted to the United States District Courts for the Southern District of New York and the Eastern District of New York, as well as the Second Circuit Court of Appeals.
Pro bono/Community Service:
- Mr. Barnes is a Member of the Catholic Charities Volunteer Lawyers Initiative, which organization provides free legal advice and services to needy members of the community. In the Summer of 2007, Mr. Barnes served as a Member of the Steering Committee for the Third Annual Long Island Business News Golf Outing and Casino Night for the benefit Hofstra University’s Scholarship Fund. From 2002 through 2004, Mr. Barnes served as member of the Board of Directors for the Cross Island YMCA.

- Mr. Barnes has written nearly three dozen articles which have been featured in his monthly column for the Suffolk County Bar Association’s periodical, The Suffolk Lawyer, focusing exclusively on commercial litigation. In addition to these regular contributions, Mr. Barnes has likewise authored articles for The New York Law Journal, including: Substantiating Malice for Tortious Interference Claim Getting Difficult, New York Law Journal, August 19, 2010; ‘Economic Interest’ Defense to a Tortious Interference Claim, 236 New York Law Journal 56, September 20, 2006; Spies, Lies & Business Torts, 235 New York Law Journal 90, May 10, 2006; Defense Protocol for Elevator Accidents, 232 New York Law Journal 109, December 7, 2004; and To Jump or Not to Jump? Elevator Accidents and Employment Expertise, 223 New York Law Journal 24, February 4, 2000. When the New York State Court of Appeals issued White Plains Coat & Apron Co. v. Cintas Corp., a significant decision for commercial litigation practitioners, Mr. Barnes was interviewed and quoted in the ensuing New York Law Journal article reporting the decision and its import on commercial litigation practice.
- In November 2011, Mr. Barnes was selected to participate as a Panel Member for the New York State Bar Association's Judicial Institute on Professionalism annual Convocation on Lawyer Independence, addressing Challenges and Best Practices for Solo and Small Firm Practitioners. As part of the Institute’s mandate to examine and promote professionalism in the practice of law, the Institute examined the particular challenges solo and small firm practitioners confront in serving their clients. Other Outstanding Achievements:
- Mr. Barnes was appointed as a Receiver by a United States District Court Judge in a Federal Court, seven-figure, mortgage foreclosure action related to a commercial mixed-use property within the City of New York; the Receivership appointment documented a rent collection diversion scheme intended to deprive the lending institution of operational income, resulting in the recovery of counsel fees incident to the same.
- Mr. Barnes was designated by a Commercial Division Justice to serve as a discovery referee in a highly-contested dissolution proceeding pending in that Court.
