Profile

Brian's practice is devoted to commercial litigation and business disputes, including fiduciary litigation. Brian's fiduciary litigation experience includes: (1) Representing a successor trustee in a lawsuit against the original trustee for breach of fiduciary duties, breach of the duty of loyalty, conversion, unjust enrichment, breach of contract, and an accounting; (2) Representing a life insurance company in a dispute between beneficiaries of a trust; (3) Representing parties in cases involving fiduciary obligations in partnerships, limited liability companies, and closely held corporations; and (4) Representing a party in a dispute involving a commercial transaction in which the opposing party asserted a fiduciary relationship. In addition, Brian's other commercial litigation experience includes representing corporations in cases involving contract disputes, insurance coverage, business torts, the Uniform Commercial Code, antitrust issues, and non-compete agreements. He also has experience in representing clients in alternative dispute resolutions and class action litigation. Brian's practice also involves consulting clients to avoid future litigation.
