Profile

Any lawyer is smart enough to practice law, but not every lawyer has the heart for the fight. In the criminal courts disputes are resolved through the adversarial process. The government has a lawyer that prosecutes. The accused has a lawyer that defends. If both sides are not zealous in their representation, the contest will not produce a reliable result. If one side does not fight, the outcome will not be a fair and just one. Often this means that the accused is sentenced to prison, separated from loved ones and branded with the stigma of criminality. I believe in the adversarial system and the good fight. A lawyer has to train to be a good fighter and I have trained with the country's best trial lawyers and jury consultants. In turn I teach trial skills to other lawyers around the country with speaking presentations in New York City, Las Vegas, San Antonio, Birmingham and Key West. I am also the Senior Instructor at the Tennessee Criminal Defense College each year. While cases should be settled if possible, I believe settlement should be on our terms, not just the prosecutor's. Long ago I heard it said that negotiation is best done from a position of strength. The truth of that statement rings like a bell. My firm brings strength to the table through team work and hard work. In short, the best way to settle a case is to be prepared to fight it and to bring the fight forward. Pro bono/Community Service: This firm keeps at least one active pro-bono case, usually a first degree murder indictment where it appears that the government is substantially over charging the accused or that the accused is actually innocent. Two recent first degree cases were resolved favorably - one by jury verdict of a misdemeanor and 11/29 probation, the other by negotiation as a reckless homicide with 2 years probation.
Scholarly Lectures and Writings: While President of the Tennessee Association of Criminal Defense Lawyers, six articles were written for publication in the TACDL's bi-monthly magazine, For The Defense.  The June 2007 article was written in memory of my colleague and friend, Robert Wayne Ritchie, one of the finest lawyers and people I have ever known.  The other writings were intended as a trumpet call to the criminal defense lawyers of Tennessee - a trumpet call to learn and develop the skills of advocacy and persuasion needed to thrive in today's hostile adversarial environment. Verdicts and Settlements: Here are some highlights from cases defended over the last 7 years. Many involve the most serious charge - homicide. There have been other trials on other offenses with favorable results, and there have been numerous felony drug charges reduced to misdemeanors - too many for this list. But no lawyer can win every case. While I cannot promise these results in every case, I hope to show that they are indeed obtained with consistency.
