Profile

Chad M. Hagan is a trial attorney with the law firm of Hagan Noll & Boyle, LLC, in Houston, Texas.  Mr. Hagan's practice is focused in the area of complex commercial litigation, with an emphasis on litigating unlawful competition, labor and employment disputes, satellite piracy and business contract disputes before federal courts around the country. Mr. Hagan has represented clients in numerous suits involving foreign corporations and the DBS Satellite industry, including a multi-billion dollar business dispute between domestic and international-based corporations involved in the conditional access and encryption arena. Mr. Hagan recently represented several U.S. telecommunications companies and their security affiliate to secure a favorable judgment in the aggregate amount of $626 million dollars and permanent injunctive relief against a Korean-based manufacturer and importer of satellite reception devices used to circumvent technology deployed to protect access to copyrighted works.  The award was the fourth largest IP judgment in the United States in 2010 according to Law360.  Mr. Hagan has represented similar clients in similar actions resulting in judgments ranging from $20 million to $151 million dollars in statutory damages as well as permanent injunctive relief. In 2008, Mr. Hagan was lead counsel for DISH Network and NagraStar in a case against a conditional access provider that led to the entry of a nationwide permanent injunction in his clients' favor.

Mr. Hagan's representation covers a wide array of business disputes including the successful defense of a multi-million dollar shareholder derivative suit, international programming disputes, software development litigation, trademark infringement defense and prosecution, labor and employment disputes and products liability claims. In addition to traditional litigation claims, Mr. Hagan also represents content distributors and encryption providers in executing writs of seizure under the Digital Millennium Copyright Act including recent actions in California, Florida and Kentucky. Mr. Hagan has also worked in close connection with both domestic and foreign governmental agencies in joint litigation efforts including the Federal Bureau of Investigations, United States Attorney's Office, US Customs, and the Royal Canadian Mounted Police.

Mr. Hagan's practice covers the full scope of pre-trial, trial and post-trial litigation undertakings, with extensive experience in complex motion practice and discovery in both federal and state litigation matters across the United States.
