Profile

John Flood, a partner in Flood & Flood’s Corpus Christi office, has represented thousands of injured people throughout Texas and the United States in product liability, toxic tort, premises liability and wrongful death cases. In addition, Mr. Flood has been hired by individuals and companies to prosecute stock fraud, insurance fraud, breach of fiduciary duty, and pollution claims. Since joining Flood & Flood, he has won jury verdicts in wrongful death, personal injury and business cases, including a case in the National Law Journal’s March 2011 list of the Top 100 Jury Verdicts in 2010, Umma Resources v. Key Energy.

Before joining Flood & Flood, Mr. Flood practiced at Hilliard & Munoz, where he prosecuted toxic tort, pharmaceutical, wrongful death and personal injury litigation. His work with physicians, engineers, toxicologists and other experts in benzene, vinyl chloride, dioxin and pharmaceutical litigation earned him praise from both plaintiffs and defense counsel.

He has the highest “preeminent” AV-Rating through Martindale-Hubbell, which is the best possible rating an attorney can obtain in review by his peers. Mr. Flood is a member of the Corpus Christi and American Bar Associations; State Bar of Texas; Bar Association of the Fifth Federal Circuit; Texas Trial Lawyers Association; American Association of Justice; and the Million Dollar Advocates Forum.

Verdicts and Settlements:

  • Commercial Litigation: Carpenter v. Merrill Lynch, et al.: Represents minority shareholders in a breach of fiduciary duty suit against a majority shareholder and its controlling parent.  A confidential settlement with officers of the company and advisors to the board has already been reached.   Gibson, et al. v. Credit Suisse.  Along with a group of excellent lawyers from around the country, Mr. Flood is prosecuting a lender liability class action in Boise, Idaho, federal court.   Umma Resources v. Key Energy. Successfully tried this case over a damaged gas well to a nationally-recognized top verdict in April 2010.  The case settled on appeal for a confidential amount.   EIS v. Citgo, et al.  Mr. Flood’s work in this illegal interference with commercial relations case won a favorable confidential settlement for his client.   Various other cases involving illegal interference by competitors in a market, commercial lending, breach of contract, and tortious interference.   Represents both lawyers and clients in suits alleging violations of fiduciary duties.
  • Railroad Crossing Litigation: Mr. Flood has represented families who have lost loved ones killed by poorly designed or malfunctioning railroad crossings. Such cases require a particularly quick response in order to preserve key evidence.
  • Pollution and Property Damage Cases: Mr. Flood has successfully represented landowners whose property was polluted by refineries, oil & gas exploration and production, smelters, utilities, and other commercial facilities.
  • Inadequate Security Cases: Zapata v. Denny’s. Mr. Flood’s client was stabbed by a drunken patron at a Denny’s restaurant.  After winning a favorable verdict at trial, the case was settled confidentially.
  • False Imprisonment: Mr. Flood has handled many lawsuits arising out of false imprisonment, including the case of a man held against his will by shopping mall security, a man killed by apartment security guards, a witness falsely arrested for failing to appear for a deposition, and a customer falsely imprisoned by a grocery store. All of these lawsuits led to confidential settlements for Mr. Flood’s clients.
  • Industrial Accidents: Brown v. Texas Molecular. Mr. Flood was asked by the legendary trial lawyer David Perry to assist in this case involving the tragic poisoning death of a client at a hazardous waste facility. A thorough investigation led to a confidential pre-trial settlement.   For 20 years, Mr. Flood has worked on cases involving injuries and deaths that have occurred in the oil & gas, refining, waste, chemical, pipeline, and electrical industries.
  • Product Liability: Millangue v. Pentron. Confidential settlement. Mr. Flood represented the family of a man who had never smoked yet died of lung cancer. Mr. Flood’s investigation revealed that his client had worked on dental appliances containing various toxins, including beryllium. Mr. Flood’s work on dosage and causation in this case (possibly the first of its kind) helped secure a settlement for his client’s surviving family members.   Juarez v. Ford. Confidential settlement. Mr. Flood represented the family of a man who was killed when the roof on a Ford F250 completely buckled in a rollover.  A quick investigation showed a stronger roof would have saved the father of four.   Benzene cases.  Since 1995, Mr. Flood has represented people all over the country who have been injured or killed by benzene, a byproduct of crude oil that can cause a form of cancer called acute myelogenous leukemia. Mr. Flood has secured settlements for many families whose loved ones suffered and died from this terrible disease.   Mr. Flood also has represented clients who have been injured or poisoned by other products and devices, including denture cream, Reglan/Metoclopramide, DePuy hip implants and Darvon/Darvocet.
  • Highway Construction Defect Cases: Contreras v. Haas-Anderson. Total settlement: $2.75 million. After deducting legal fees of $1,080,265 and expenses of $69,735, the client received $1.6 million. Mr. Flood was retained within days of the accident and was able to videotape and photograph the dangerous pavement drop-off that caused the accident before the construction company was able to cover it up.
  • Motorcycle Injury and Death Cases: Browning v. Colonial Freight, confidential settlement. Represented client who was blamed by police after colliding with an 18-wheeler. Mr. Flood’s investigation showed that the truck driver was at fault and a federal court jury in Waco, Texas agreed.   Has also represented the families of motorcyclists killed by dangerous highway defects.
