Profile

In the last ten years, Mr. Kennedy has successfully tried six intellectual property cases, including two patent infringement cases, two copyright infringement matters, a trade secrets case and a dispute concerning an intellectual property licensing agreement. He won a jury verdict of $4.7 Million plus fees and costs in a copyright case in April of 2008. In December, 2006, he obtained an order granting sanctions for $27 Million against a party in violation of a preliminary injunction in a software copyright case. He has recently obtained three preliminary injunctions in different jurisdictions covering copyright protected software and trade secrets. Each injunction included an accompanying impoundment order requiring the impoundment of more than 100 different pieces of computer equipment. In February, 2003, Mr. Kennedy prevailed in an appeal at the Court of Appeals for the Federal Circuit in a matter concerning proper claims construction in a patent case.
