Probate court is where Wills are admitted and where estates without Wills are divided and supervised by the Court.  A Will is not validated until the Court admits it to probate.  The Court requires that all interested parties receive notice of the proceedings so that if there is a more recent Will, claims of fraud or wrongdoing are at issue, or disinherited heirs want to lodge a claim against the Estate, they have their forum and opportunity to do so.  Many people don’t understand that Wills have to go through probate.  This system is in place to make sure that the estate goes to the right people and that creditors are paid.
