Ben's practice is focused on the defense of DUI and other serious driving offenses. Ben has been a speaker for the Georgia Probate Judges' Traffic Conference, the Georgia Municipal Court Judges' Law & Practice Update, the National College for DUI Defense, Georgia Association of Criminal Defense Lawyers, Georgia Public Defender Standards Council, New York State Bar Association, and Georgia ICLE. Most recently, he served as the Co-Chair for ICLE's DUI 101 Seminar.

Ben has successfully litigated (and changed the law) in several important DUI and criminal defense cases before the Georgia Court of Appeals and Georgia Supreme Court. 

  • Awad v. StateA criminal defendant's refusal to provide a urine test was protected by the Self-Incrimination Clause of the Georgia Constitution and could not be used as evidence against him. This case overturned several prior cases decided by the Georgia Supreme Court and Court of Appeals. 
  • Mitchell v. State -Harper foundation is required to determine the admissibility of Romberg test evidence. This case has resulted in the vast majority to drug recognition evidence being inadmissible in DUI/criminal cases. 
  • Walker v. StateGeorgia trial judges regained their power to dismiss criminal cases for want of prosecution after the expiration of the statute of limitations. 
  • Rogers v. State - Is a statutory speedy trial filed in combination with multiple other motions valid?
