DraftKings Account Freeze: Legal Steps To Recover Your Money

Thousands of users of platforms like DraftKings face this disruption after deposits, winnings, or both are locked during a review process.
The uncertainty creates immediate concern, especially when customer support responses are limited or delayed. When funds are held without a clear timeline or resolution, understanding your legal rights and seeking legal guidance are the first steps toward recovery and accountability.
Why DraftKings Freezes or Restricts Accounts
There are several reasons a DraftKings account may be frozen or restricted.
User’s Failure To Complete ID Verification
The user may not have completed ID verification or submitted the required documentation, as anti-money laundering laws require gambling operators to verify each user’s identity. The platform must ensure that each account holder is legally permitted to use it.
Identification requirements are included in the user agreement. So by not complying, the user isn’t adhering to the user agreement. DraftKings asks for several pieces of information to confirm someone’s identity when opening a new account:
- Full legal name
- Date of birth (must meet legal gambling age)
- Social Security number (full or last four digits)
- Government-issued ID, such as a driver’s license or passport
If an account gets flagged, additional address verification may be required, such as a utility bill or bank statement.
Failing To Consent to Location Tracking Requirements
In addition to address verification, location tracking is required. Because states have differing laws, DraftKings must confirm that users are physically in a state where online gambling is legal. That means a user must consent to GPS, Wi-Fi, or IP tracking.
Not Providing a Valid Payment Method
DraftKings requires each account to have a payment method. That means completing credit card, debit card, or bank account verification. To prevent fraud, the payment method must match the person creating the account.
Flagging Accounts for Potential Legal Issues
New accounts that meet all of the identification requirements may still trigger a freeze or restriction. DraftKings monitors account activity for unusual behavior. Accounts can be flagged for potential fraud, bonus abuse, or having multiple accounts.
In rare cases, DraftKings may freeze an account due to a court order. Wage garnishment or financial account liens can happen when someone is behind on their child support. A DraftKings account could fall under this if it has a significant balance.
When KYC Checks Happen
Identity checks are performed multiple times. The information is first requested when the account is created, then again before the first withdrawal.
If the account is flagged for additional review, DraftKings may require additional documentation to verify a person’s identity. It can also be requested if there are changes in regulations that require DraftKings to request information to stay compliant.
What Happens to Your Money When an Account Is Frozen
The balance in a frozen bank account is placed in an alternate holding account managed by DraftKings. Any withdrawal requests could be delayed while the account is frozen.
If there are pending bets or unsettled wagers, these may remain in place while the company investigates. If an investigation leads to an account closure, it can make it more difficult to recover the money. If fraud or policy violations are found, withdrawal requests are likely to be rejected.
Step 1: Internal Dispute With DraftKings
The first step users should take when their account is frozen is to contact DraftKings customer support. Submit a formal written complaint that requests an account statement and the specific reason for the account freeze.
If DraftKings requests additional information, provide it. Keep a written record of communications and documents provided. If DraftKings withheld funds, include a request for a written denial of the payout.
Step 2: Escalation Within the Gambling Regulatory System
When contacting customer support doesn’t resolve the issue, users may need to escalate their complaint. Filing a complaint with the appropriate state gaming regulator is a logical step. Regulators can request a response from DraftKings or an explanation of the investigation.

It also isn’t wise to delete the account and try to start over with a new one. DraftKings maintains user records and is required to verify identities. A new account would be flagged for making duplicate accounts. It could also be viewed as attempting to commit fraud. These would make the situation worse.
